What is the Generic Drugs Pricing Class Action About? 


The Generic Drugs Pricing Class Action alleges that Sun Pharmaceutical Industries, Inc. and its affiliates (Caraco Pharmaceutical Laboratories, Ltd., Mutual Pharmaceutical Company, Inc., URL Pharma, Inc.), and Taro Pharmaceuticals U.S.A., Inc. (collectively "Settling Defendants") violated federal antitrust laws. The lawsuit claims they conspired with other generic drug manufacturers to fix, maintain, and stabilize prices, rig bids, and engage in market and customer allocations of certain generic drugs, causing direct purchasers of these drugs to pay more than they should have. The Settling Defendants deny all allegations of wrongdoing.

Am I eligible to get a payout in the Generic Drugs Pricing Class Action? 


The class includes all persons or entities, and their successors and assigns, that directly purchased one or more of the named generic drugs from any of the defendants in the United States and its territories and possessions, at any time during the period from May 1, 2009, through December 31, 2019. Excluded from the class are the defendants, their officers, directors, management, employees, subsidiaries, affiliates, and all governmental entities. This settlement is for direct purchasers only. If you purchased any of these drugs from a retail pharmacy (Walmart, CVS, for example), you are not an eligible Class Member. 

Is Proof of Purchase Required in Order to File A Claim? 


NA. If you purchased directly from the defendants, they will have a record of your purchase(s) and a claim form will be mailed to you directly. 

How Much Money Can I Get? 


The settlements provide a total of $85,000,000, with Sun Pharmaceutical Industries, Inc. and its affiliates paying $17,357,000 and Taro Pharmaceuticals U.S.A., Inc. paying $67,643,000. The actual amount each class member can receive depends on several factors, including the number of claimants and the details of the approved claims.


How Can I File a Claim? 


To file a claim and be eligible for a share of the Settlement Fund, class members must return the Claim Form by May 6, 2024. 

The Claims Administrator will mail Claim Forms to Settlement Class Members whose purchase information is available. 

If you did not receive a Claim Form in the mail, you may contact the Claims Administrator at info@GenericDrugsDirectPurchaserSettlement.com with the name and address of the potential Settlement Class Member. Claims can be submitted without needing to provide a receipt or proof of purchase.
