What is the Five Guys Class Action About? 

The Five Guys Class Action alleges that Five Guys Enterprises, LLC (“Five Guys”) failed to adequately protect the personally identifiable information (“PII”) of current and former employees, as well as a small number of dependents or beneficiaries and independent contractors, due to a security incident that occurred around September 2022. This incident potentially exposed their PII due to the use of internet tracking technology, including "pixels," on its websites and MyChart patient portal. Five Guys denies all claims and maintains it did nothing wrong but agreed to settle to avoid litigation costs.

Eligible class members include individuals to whom Five Guys sent a Notice of Security Incident announced around December 29, 2022. This encompasses current and former employees, and likely a small number of dependents or beneficiaries and independent contractors, whose PII may have been exposed due to the security incident.

Is Proof of Purchase Required in Order to File A Claim? 

Yes, proof is required for class members claiming reimbursement for out-of-pocket expenses and compensation for time spent remedying issues related to the security incident. This includes receipts, bank statements, card statements, invoices, tax documents, or other relevant documentation.

How Much Money Can I Get? 

Eligible class members can request reimbursement for out-of-pocket expenses up to $400 for ordinary expenses and up to $6,500 for extraordinary losses such as fraud or identity theft. California residents may request an additional $100 cash payment. Those not claiming specific expenses or who choose not to may receive a one-time payment of $150. Settlement payments may be adjusted pro rata depending on the number of valid claims filed.
